Carnegie Telephone Company, hereinafter “us”, “we”, “the company”, and you as a user, referred to as “I”, and as the submitter of an image to our Photo Contest upload page at https://carnegietelco.com/photo-contest, hereby agree to the following terms and conditions.
Original Work
I certify that the photos, graphics files, or other material submitted through the online upload form, is my own original work, and that the resultant files are my own property, free and clear of any copyright, claim, trademark, or other restriction.
Types of Entries Allowed
Photographs shall be uploaded in a digital format, using either “JPEG” (Joint Photographic Experts Group) or “PNG” (Portable Network Graphics) formats. The maximum file size is 25 MB. Submission of the highest-quality file type is desirable, and images submitted of a substandard technical nature, meaning either low resolution, compression artifacts, or other deleterious quality, may be deemed inadmissable at the sole and exclusive judgment of The Company. Images must not be of a lewd, obscene, or explicit nature. Such entries may be deemed inadmissable at the sole and exclusive judgment of The Company.
Copyright Release
I hereby grant, convey, bargain, devise, and license the use of my photograph to the company for any and all uses, without royalty or payment, for perpetuity. This shall apply whether or not my submission is selected as the contest winner. The company may use my photograph for any purpose, including, but not limited to: marketing materials of an electronic or print nature, trade literature, submissions to industry publications, submissions to publications or periodicals of any nature. The company may alter my image in any way deemed necessary for their uses.
Contest Rules
The company, its heirs, assigns, subsidiaries, contractors, employees or managers shall determine the winner of the contest through whatever type of judging criteria they determine. They may enlist the aid of the general public through a opinion poll or survey, through the selection of any person or group of persons they may determine, through any method, to influence their decision.
The contest is open to any person who is a citizen or legal permanent resident of the United States age 18 or older. For contest entrants under 18 years of age, a parent or legal guardian may submit an entry on their behalf.
The winner of the contest shall be required to sign a written copyright release or other authorization forms prior to the disbursement of any prize money. Refusal to grant a release or sign any related or required documentation to attest to that fact shall be deemed as ineligibility for the prize and/or prize money. The Company may then select another entry, at its sole and exclusive option, to be the winner.
Entries must be submitted no later than 6:00 PM Central Daylight Time on August 11, 2021. Entries submitted after that date and time are subject to refusal of entry into the contest.
Severability
If any part of this agreement is found to be unenforceable by a Court of Competent Jurisdiction within the State of Oklahoma, it is agreed that the remainder of the agreement shall continue in force and effect.
Choice of Law
This agreement shall be construed and interpreted by the laws of the State of Oklahoma. Any action at law or equity regarding this agreement shall be filed at the District Court of Caddo County, State of Oklahoma, or with the United States Court for the Western District of Oklahoma.
Indemnification
I agree to indemnify, hold harmless, and defend The Company at any action at law or equity involving the submission of my photograph.
